Judge Collier's Criminal Docket for May 21, 2012

The following people appeared in court May 21:

Brian Davis, 19, of Hadcock Road in Brunswick, was sentenced to two years of community control sanctions on one count of Trafficking in Marijuana and one count of Trafficking in Drugs, both of which are fifth-degree felonies. His driver’s license was suspended for six months.

Robert Kashnier, 25, of Frantz Road in Medina, was sentenced to two years of community control sanctions on one count of Theft of a Motor Vehicle, a fourth-degree felony. He also was ordered to pay $8,500 in restitution.

Mark Meyers, 27, of Steigler Road in Valley City, was sentenced to two years of community control sanctions, with 180 days in jail, on two counts of Receiving Stolen Property, both of which are fifth-degree felonies. He also was ordered to pay $225 in restitution.

Shane Brinker, 29, of West Salem Road in Burbank, pleaded not guilty to one count of Possession of Drugs and one count of Possession of Cocaine, both of which are fifth-degree felonies. A jury trial is scheduled for August 20.

Evan Furillo, 19, of Guilford Road in Seville, pleaded not guilty to one count of Trafficking in Marijuana, a fifth-degree felony. A jury trial is scheduled for August 22.

Christopher Hamblen, 19, of North Harmony Street in Medina, pleaded not guilty to one count of Trafficking in Marijuana within the Vicinity of a Juvenile, a fourth-degree felony. A jury trial is scheduled for August 20.

Anthony Hinton, 43, of North Lyman Street in Wadsworth, pleaded not guilty to one count of Abusing Harmful Intoxicants, a fifth-degree felony. A jury trial is scheduled for August 20.

Sasha Patterson, 25, of West 140th Street in Cleveland, pleaded no contest to one count of Theft of a Drug, a fourth-degree felony. Sentencing is scheduled for July 2.

Michael Plymale, 22, of Prospect Street in Wooster, pleaded not guilty to two counts of Receiving Stolen Property, Checks, both of which are fifth-degree felonies. A jury trial is scheduled for July 16.

Johnny Roden, 33, of Norwalk Road in Litchfield, pleaded no contest to one count of Possession of Drugs, a fifth-degree felony; three counts of Deception to Obtain a Dangerous Drug, all of which are fifth-degree felonies; and one count of Attempted Deception to Obtain a Dangerous Drug, a first-degree misdemeanor. Sentencing is scheduled for July 2.

Raymond Scholle, 26, of Hadcock Road in Brunswick, pleaded no contest to one count of Trafficking in Drugs, a fourth-degree felony. Sentencing is scheduled for July 2.

Shawn Shea, 19, of Andrews Road in Medina, pleaded not guilty to three counts of Trafficking in Marijuana, all of which are fifth-degree felonies. The charges carry a forfeiture specification. A jury trial is scheduled for July 11.

Larry Spence II, 43, of Garden Street in Creston, pleaded not guilty to one count of Possession of Heroin, a fifth-degree felony. A jury trial is scheduled for August 20.

Jason Stanek, 30, of River Road in Hinckley, pleaded not guilty to two counts of Robbery, one of which is a second-degree felony and one of which is a third-degree felony. A jury trial is scheduled for July 16.

Shavonne Szmahlo, 25, of Princeton Drive in Brunswick, pleaded guilty to one count of Complicity to Commit Trafficking in Drugs, a fourth-degree felony and one count of Trafficking in Marijuana, a fifth-degree felony. Sentencing is scheduled for July 2.

Wadsworth Man Sentenced to Prison for Sex with Teenager

Judge James Kimbler sentenced Ronald R. DeFranco, 48, of Hartman Road in Wadsworth, to one year in prison for Attempted Unlawful Sexual Conduct with a Minor, a fourth degree felony. The victim was 15 years old when the offense was committed. The offense occurred at DeFranco's home when he was watching her while her parents were out. 


DeFranco's relationship with the girl came to light after she told friends of her at her high school about "Uncle Ron" and her being a couple. These friends alerted the school administrators who in turned called the girl's parents. When the parents were told of their daughter's use of the term "Uncle Ron" they knew that their daughter was referring to DeFranco. DeFranco had known the girl since she was six years old. DeFranco had met the girl because he was close friends with the girl's step-father, having known him for over 20 years. 


After the girl's parents found out about DeFranco's relationship with their daughter, they confronted him. DeFranco admitted that he had had sexual contact with their daughter. He told them that "It's all my fault, I shouldn't have led her on." 


Although initially charged with a third degree felony, DeFranco agreed to enter a guilty plea to the amended charge. Besides sentencing DeFranco to a year in prison, Judge Kimbler also labeled him a Tier II sex offender and must register every 180 days for 25 years. He will also be under post-release control by the Adult Parole Authority for a mandatory period of five years after being released from prison.

Judge Kimbler Arraignments for May 17, 2012

Anthony Cole, 22, of Reid Street in Chippewa Lake, pleaded not guilty to one count of Identity Fraud, a fifth-degree felony. A jury trial is scheduled for July 17.

Rosemarie Kinney, 51, of North Prospect Street in Lodi, pleaded not guilty to one count of Possession of Drugs, a fifth-degree felony. A jury trial is scheduled for July 18.

Rebecca Phillips, 28, of Miner Drive in Medina, pleaded not guilty to three counts of Trafficking in Drugs, all of which are fourth-degree felonies. A jury trial is scheduled for July 23.

Stephen Swain, 28, of Birch Hill Drive in Medina, pleaded not guilty to one count of Domestic Violence, a fourth-degree felony. A jury trial is scheduled for July 16.

Richard Umble, 34, of South Broadway Street in Lodi, pleaded not guilty to one count of Trafficking in Marijuana, a fifth-degree felony. A jury trial is scheduled for July 18.

David Witte, 28, of Calaboone Road in Doylestown, pleaded not guilty to two counts of Driving Under the Influence of Drugs or Alcohol, both of which are fourth-degree felonies. A jury trial is scheduled for July 9.

William Yuravak, 25, of Meadowood Drive in Medina, pleaded not guilty to one count of Improperly Handling a Firearm in a Motor Vehicle, a fourth-degree felony, and one count of Possession of Cocaine, a fifth-degree felony. A jury trial is scheduled for July 12.
